Responding to Supreme court in affidavit, Enforcement directorate had informed the court that Kejriwal is the ‘Kingpin’ and key conspirator of the Delhi Excise policy case.

The investigative agency further revealed that undertaking arrest of an individual on the basis of the evidence doesn’t amount to the undermining of free and fair elections.

As per ED, Kejriwal collaborated with leaders of AAP and ministers and also asked for the kickbacks from liquor businessmen in exchange of Favours given through this policy. As a result, Aam Aadmi party became the beneficiary of the proceeds of the crime. Whose half were utilized in election campaign of Goa in the year 2022.

Between the period of the scam and when it became public, approximately 170 phones were destroyed by 36 persons.

Further, it was pointed out that for investigative purposes, Kejriwal was asked to provide the passwords to his mobile phone. This request was made again. However, Kejriwal refused to share the password. Despite being presented with evidence of the same during his custody, the petitioner was completely evasive.

ED further alleged that taking advantage of his position, he facilitated the offence which is punishable under the Prevention of Money Laundering Act. And the crime has taken place with his knowledge. He didn’t take any measures to prevent  such scam from taking place.
