Son’s Drowning: Charges Possible for Emilie Kiser’s Husband

Brady Kiser, the husband of influencer Emilie Kiser, will not face criminal charges in relation to the drowning death of their three-year-old son, Trigg, who passed away on May 18 at Phoenix Children's Hospital. Brady 
According to the Daily Mail, Maricopa County Attorney Rachel Mitchell stated in a statement that "every case submitted to the Maricopa County Attorney's Office is evaluated using the same standard: whether there is a reasonable likelihood of conviction."

"It was concluded that this case does not meet that standard after a thorough review of the evidence provided by Chandler PD."

According to a search warrant affidavit, Brady told police that he didn't see Trigg for some time because he was busy with the couple's newborn kid, Theodore. But when he went to look for him, he discovered his 3-year-old unconscious in the pool. Then he called 911. Flynn Carey, his attorney, said his client is lucky that the case was thoroughly investigated and found to be an unfortunate accident.
"We appreciate that the county attorney and law enforcement carried out a comprehensive investigation and verified that this was a tragic accident."

Brady Kiser Not Indicted over Son's Drowning Death

There have been no charges indicating wrongdoing by Brady Kiser, Emilie Kiser's influencer wife in relation to the unfortunate accidental drowning of their son, Trigg, aged 3 years old. The Maricopa County Attorney's Office released a statement saying that after reviewing all evidence against Kiser, it was determined that there was no reasonable possibility of conviction despite the Chandler police's recommendation that felony child abuse charges be filed against him. On May 12, 2025, Trigg was discovered unresponsive at his family's pool in Chandler, AZ, after Kiser admitted that he lost track of Trigg while caring for their newborn.

Legal Scrutiny and Public Inquiry

Following the incident, law enforcement authorities recommended that Brady Kiser be charged with a Class 4 felony for child abuse; however, the county attorney underscored that not all tragedies amount to criminal negligence, stressing that evidence did not meet the legal threshold for prosecution. Brady's lawyer commented on the relief the family feels over the conclusions of the investigation, which confirmed that it was indeed a tragic accident. Meanwhile, Emilie Kiser sought privacy for the family, requesting court orders barring the case records from public scrutiny as the family continues to grieve.

The Kiser family has not only lost a child, but it has also to come under public scrutiny as it goes through mourning.
