Former FBI Director James Comey has launched a new legal argument to dismiss the criminal case against him, asserting that his 2020 testimony to the U.S. Senate was “literally true.” This step deepens his legal fight before trial over accusations that he lied to Congress. Comey’s lawyers argue that the questions he was asked were too unclear to justify a false statements charge, marking a bold new phase in his defense.

What is the Core of Comey’s New Argument?

The heart of Comey’s latest legal filing is the assertion that for a false statement charge to stand, both the questions and the answers must be clear and unambiguous. His lawyers argued, “Fundamental to any false statement charge are both clear questions and false answers. Neither exists here.” They specifically point to the line of questioning from Republican Senator Ted Cruz, suggesting the senator’s words were open to interpretation. Comey’s team claims their client’s responses were truthful based on his understanding of the questions at that moment.

What Specific Testimony is Under Scrutiny?

The criminal case centers on Comey’s statement during a Senate hearing that he stood by prior testimony. In that prior testimony, he said he did not authorize anyone at the FBI to be an anonymous source for news reports concerning investigations into Donald Trump and Hillary Clinton during the 2016 election. Prosecutors allege this was a lie because Comey had, in fact, authorized a former FBI special employee, Daniel Richman, to share information with the media. Comey has pleaded not guilty to the charge.

How Does Comey Explain the Ambiguity?

Comey’s defense draws a sharp distinction between two different leaks. The indictment focuses on his authorization of Daniel Richman. However, during the Senate hearing, Senator Cruz’s questions referenced a leak made by Comey’s former top deputy, Andrew McCabe, to the Wall Street Journal. Comey’s lawyers now argue that he could have reasonably believed Cruz’s questions were solely about McCabe, not about Richman or any other individual. They state that Comey had no prior knowledge of McCabe’s specific actions.

What Other Legal Challenges is Comey Making?

This is not Comey’s only attempt to have the case thrown out. He has pending legal challenges that argue he is a victim of political targeting. His legal team claims the case is fueled by Donald Trump’s “personal spite” against him. Additionally, they are contesting the appointment of the prosecutor, Lindsey Halligan, who brought the case. Halligan, a former personal lawyer for Trump with no prior prosecutorial experience, was installed after Trump pushed out her predecessor.

What is the Broader Political Context?

Comey was the first of several of Trump’s political adversaries to be charged recently. The Justice Department has also taken legal action against New York Attorney General Letitia James, who sued Trump for fraud, and former National Security Advisor John Bolton, one of his outspoken critics. This has fueled claims that the department is being used for political retaliation. Officials have declined to comment on the active cases.
