Tired Of Candy For Change? Legal Steps To Address MRP Overcharging

Government regulations mandate that the Maximum Retail Price (MRP) of all goods must be prominently displayed, and customers are obligated to pay only the listed price. However, many consumers encounter situations where they are charged more than the MRP or offered chocolates as change instead of coins.

This often goes unnoticed due to a lack of awareness. Customers who do notice the discrepancy may hesitate to act, assuming there is no remedy. In reality, they have a legal right to claim back the overpaid amount and seek justice if shopkeepers refuse a refund.

Legal Insights into Overcharging Practices

Vadodara-based lawyer Viraj Thakkar explained to Local 18 that charging more than the MRP is a clear violation of Supreme Court regulations. Exceptions apply in specific cases, such as restaurants and cafes, where a service charge may be legally added. In retail, consumers are also entitled to ensure they receive the exact weight of purchased products. For instance, if a customer pays for 500 grams but receives only 450 grams, they can demand the remaining amount.

Despite these rights, many consumers avoid addressing overcharging to escape the perceived hassle of legal proceedings. However, the Consumer Protection Forum provides a straightforward avenue to address grievances and secure refunds with added interest.

How and Where to File a Complaint

Overcharging is categorised under “misleading practices” as per the Consumer Rights Protection law. Victims of overcharging can file complaints at their local Consumer Court or District Consumer Forum without incurring fees. If the shopkeeper is found guilty, they could face penalties, including fines.

The process ensures that consumer rights are upheld and empowers buyers to take action against unfair practices. By being vigilant and utilizing the available legal channels, customers can help curb the widespread issue of overcharging.
