The Supreme Court in the case Anchal Kushwaha V. High Court of Delhi observed and has refused to interfere with the order of the Delhi High Court that had dismissed the petition moved seeking the postponement of the Delhi Judicial Services Preliminary Examination, 2023, which is being scheduled to be held on December 17.
The petition moved sought postponement of DJS Prelims Examination 2023 as its date is clashing with the date of Combined Recruitment Test which is conducted by Union Public Service Commission, UPSC for various law related posts.
The bench comprising of Justice Hrishikesh Roy and Justice Sanjay Karol said in its order stated that this court see no infirmity with the view taken by the High Court in refusing to postpone the recruitment examination. Thus, the SLP is accordingly dismissed.
The counsel, Adv. Ruchi Gunjan appearing for the petitioner stated that, we are left with no option but to choose and this a violation of Article 16 of the Constitution of India.
The bench headed by Justice Roy in the case remarked that Why? You have to make choices. Thus, Suppose another date is given and it clashes with another examination? E xam cannot be postponed to suit the convenience of a particular candidate.
Adding to it, the bench of Justice Karol stated that now here you have to choose between withdrawal and dismissal of the petition moved.
Therefore, the UPSC had declared the date before Delhi High Court postponed the date to December 17th from December 10, 2023.
In the present case, the writ petition has been filed in the Delhi High Court which was dismissed by the court without notice on December 07, 2023.
The Division bench headed by Justice Yogesh Khanna in the case observed and has dismissed the petition moved where the examination has been postponed once, it is not feasible to postpone it again.
The Delhi High Court stated that the present petition has no merit.
The Delhi High Court in the case observed and has dismissed the similar plea moved plea seeking postponement of the exam.
The Division bench of Acting Chief Justice Manmohan and Justice Mini Pushkarna, while refusing the examination date dismissed the public interest litigation moved by one Vishal Yadav.
The court in the case observed that the similar writ petition has been dismissed by a coordinate bench recently.
The High Court in the case stated while keeping in view the aforesaid order i.e., passed by the coordinate bench.Accordingly, the court dismissed the plea.
