A revenue court in Haryana, presided over by Ashok Khemka, financial commissioner, has recommended the implementation of Aadhaar-based e-KYC identification to curb fraud in property deed registrations. The directive was issued during the hearing of a revision petition filed by Madan Singh, the lambardar (village revenue official) of Jatu Luhari village in Bhiwani district.
Khemka emphasized the inadequacies of the present registration act, stating that even fraudulent property deeds registered through impersonation cannot be canceled by the registrar. To address this gap, he proposed the adoption of Aadhaar-based electronic Know Your Customer (e-KYC) authentication, which leverages unique identification through Aadhaar cards to verify the identity of individuals involved in property transactions. Additionally, the court suggested the enactment of a specific law, if necessary, to combat fraud more effectively.
The financial commissioner clarified that the current legal framework lacks provisions for canceling fraudulently registered deeds and recommended that aggrieved parties approach a civil court under sections 31 or 34 of the Specific Relief Act. This move aims to provide a more robust legal recourse for genuine property owners facing fraudulent registrations and underscores the importance of incorporating technology-driven authentication methods to enhance the security and integrity of property transactions in Haryana.
