The Punjab And Haryana High Court in the case Rahul Kumar Tewary and others v. State of Punjab and another observed and has quashed the FIR filed in the year 2019 against the Colors TV and the actors and producers of the show ‘Ram Siya Ke Luv Kush’ for allegedly portraying a wrong image of Bhagwan Valmiki and it hurts the religious sentiments of the community.
The court in the case observed and took the note in an order passed in the month of October, 2019, wherein the court put the ban on the show was set aside after the producers provided the requisite undertaking to take the corrective measures.
The bench of Justice Deepak Chopra in the case stated that the statement made by the by learned counsel for respondent No.2 i.e., the complainant before the said court that he has no objection in order to quash the FIR in question, with regards to the order dated October 17, 2019 passed in CWP-25291-2019, O&M.
In the present case, the court was hearing the petition to quash the FIR as stated under Section 295-A and Section 34 of the Indian Penal Code, 1860 against the Colors TV channel, actors and the producers of the show.
The court constituted the five member committee by the State in order to examine the issue and to frame a set of guidelines to be provided to Colors TV with regards to Ram Siya Ke Luv Kush, who being the producers of the show to took the requisite undertaking to follow the guideline and take corrective steps. Thus, the High Court set aside the ban.
The court in the case observed and has quashed the FIR, while allowing the plea and has stated while considering the facts and circumstances of the case that the FIR No.92 dated 23.08.2019, which is being registered at Police Station Commissionerate, Jalandhar, District Jalandhar, under Section 295-A and Section 34 of the Indian Penal Code, 1860, the Annexure P-1 and all the court quashed all the consequent proceedings.
