In a significant legal move, a coalition of Pro-Palestinian organisations has filed a lawsuit against the Dutch government, accusing it of failing to prevent alleged genocide in Gaza and urging a ban on arms exports to Israel.

Legal Duty to Prevent International Violations

The lawsuit, filed at a civil court in The Hague, emphasizes the Netherlands’ responsibility under international law, including the 1948 UN Genocide Convention. Lawyer Wout Albers, representing the coalition, stated:
“Israel is guilty of genocide and apartheid and is using Dutch weapons to wage war.”

Demands of the Coalition

The coalition, comprising Dutch and Palestinian organisations, demands the following:

  • A ban on the export and transit of weapons and dual-use items to Israel.
  • A halt to Dutch trade and investments that sustain Israel’s occupation of Palestinian territories.

Court’s Stance on the Case

Judge Sonja Hoekstra acknowledged the seriousness of the Gaza crisis but emphasized the court’s role in evaluating legal responsibilities rather than political decisions.
“It is about ensuring respect for international law and protection against violations,” noted Albers.

Global Context of the Lawsuit

This lawsuit aligns with recent developments:

  • The International Court of Justice (ICJ) earlier declared the occupation of Palestine illegal.
  • The International Criminal Court (ICC) issued arrest warrants for Israel’s Prime Minister Benjamin Netanyahu, former Defence Minister Yoav Gallant, and Hamas’s Mohammed Deif for alleged war crimes.

Casualties and Ongoing Conflict

The ongoing conflict in Gaza has led to devastating human costs:

  • Over 44,000 Palestinians killed and 104,000 wounded since October 7, 2023.
  • Approximately 1,139 Israelis killed during Hamas-led attacks, with over 200 taken hostage.
