Uttar Pradesh: Court Clears Milkipur Poll One-Month Deadlock

The Lucknow Bench of the High Court dismissed a writ petition on Monday regarding the Milkipur Assembly seat, clearing the way for the election to proceed. The Election Commission had earlier postponed the election on October 16 due to a pending petition related to the constituency.

Samajwadi Party MP Awadhesh Prasad, speaking to ANI, highlighted the importance of the seat, particularly its connection to Akhilesh Yadav and Ayodhya. He stated, “After the Milkipur seat became vacant, the writ filed against me by a BJP member became irrelevant. It was his moral obligation to withdraw it. The public is determined to ensure Ajeet Prasad’s victory from this constituency.”

Meanwhile, BJP MLA Baba Gorakhnath, who had filed the petition, confirmed his intention to withdraw it. He explained, “The case was filed because the lawyer who notarised Awadhesh Singh’s election documents had an expired license. However, since he resigned after being elected MP, we have decided to withdraw the petition. We want the elections to proceed so the people can choose their MLA.”

Baba Gorakhnath’s advocate, Rudra Vikram Singh, elaborated that the petition, filed in 2022, stemmed from allegations of a “fraudulent” affidavit notarised by someone without a valid license. Singh added, “The Election Commission’s announcement to delay the election due to the petition prompted us to take this step. The people of Milkipur should not be deprived of their right to elect their representative.”

While bypolls were conducted in nine assembly constituencies across Uttar Pradesh, the Milkipur seat remained excluded due to the pending petition. The results of these bypolls, declared on November 23, saw the BJP winning six seats, its ally Rashtriya Lok Dal (RLD) securing one, and the Samajwadi Party winning two seats.

This resolution paves the way for elections in Milkipur, ensuring that the democratic process moves forward.
