The Supreme Court on Monday expressed concern about the ‘two-finger test’ on the rape survivors and said that anyone conducting such tests on the victims shall be held guilty of misconduct.
Supreme Court reprimanded agencies saying this practice re-victimises and re-traumatises the rape victims.
The order came from a bench of justices D.Y. Chandrachud and Hima Kohli that two-finger examination has no scientific basis and is an invasive method of examining rape survivors. The two-finger test must not be conducted must be banned immediately.’
The Supreme Court bench added that “the test is based on an incorrect assumption that a sexually active woman cannot be raped. Nothing can be further from the truth.”
The Apex court also asserted that any person conducting such a test will be considered guilty of misconduct. Furthermore, it ordered the removal of two-finger test from study materials and medical books of the medical colleges as well.
Earlier, the Supreme Court had ordered to stop the practice that two finger test method is unconstitutional, but it continued till date.
The court in its judgment said that the evidence of a victim’s sexual history is not material to the case. The bench further expressed concern about the two-fingers test stating that it is “regrettable” that it (two-finger test) is still continued today.
