The Delhi High Court issued a notice to the National Investigation Agency (NIA) on Monday in response to a petition filed by Kashmiri separatist leader Shabir Ahmed Shah. He has applied for bail in a terror funding case filed by the NIA against different separatist leaders in Jammu and Kashmir in 2017.
The agency was served with a notice by the Division Bench, which included justices Siddharth Mridul and Anish Dayal. The subject has been scheduled for further hearing on September 12.
Meanwhile, the bench has been asked to take the relevant documents into consideration. The petitioner’s counsel stated that it is a new bail application. He has been imprisoned for the previous six years. The charge sheet against the petitioner has been submitted.
On July 7, the trial judge denied his previous bail request. A bail petition has been filed on Shah’s behalf. It has been argued that the trial court judge erroneously rejected to provide bail to the appellant herein, stating that due to the bar under Section 43D(5) of the UAPA and the existence of a prima facie case at the time of charging, the appellant could not be granted release.
