The Supreme Court in the case Union of India v. Aligarh Muslim University and Ors observed and has transferred to itself the petition titled Anoop Prabhakar v. Union of India, 2014 which is pending in the Allahabad High Court wherein seeking to implement Central Educational Institutions, the Reservation in Admission Act, 2006 in the Aligarh Muslim University.
The bench comprising of Justice S Ravindra Bhat and Justice Prashant Kumar Mishra in the case observed and has passed an order on Monday wherein the court allowed the transfer plea filed by the Union of India.
However, the Parliament passed Central Educational Institutions Act, 2006 for giving reservation to SC/ST/OBC in central institutions in 2006.
Therefore, the plea was filed before the Allahabad High court in order to extend benefit of such reservation in Aligarh Muslim University in 2014.
Since the question about the status of Aligarh Muslim University is already pending before the Supreme Court in the case Aligarh Muslim University v. Naresh Agarwal, wherein the court tagged the present matter to be tagged along with it.
