Legal rights cannot be considered instigation for suicide, HC rules

The Punjab and Haryana High Court has clarified that the exercise of legal rights cannot be considered incitement to suicide. The High Court issued this order while dismissing a case registered against Kuldeep Singh, a Patiala resident, on charges of compelling suicide and several other sections.
Including a plea and several complaints against the deceased Rajneesh Kumar, wherein he was accused of dishonored checks by the petitioner and others. The deceased considered himself innocent, but after Patiala Court declared him guilty following a hearing in 2015, his appeal was also dismissed in the lower court. Subsequently, in 2016, he wrote a suicide note, claiming that he had been falsely implicated in the case along with other co-accused, which led to the filing of the present case, including the plea.
The deceased was pronounced guilty of bounced check cases by petitioners and others, although he alleged in a suicide note that he had been falsely implicated along with other co-accused by the petitioners.
While hearing the case, the High Court noted that the petitioner had been declared guilty of the bounced check case and his appeal had been rejected. Therefore, taking advantage of one’s legal remedies cannot be categorized as harassment or incitement. Accordingly, the High Court ordered the dismissal of the case filed against the petitioner.
