DELHI RIOTS: POLICE OPPOSE UMAR KHALID’S BAIL PLEA

The Delhi Police on Tuesday filed its reply in a bail plea moved by accused Umar Khalid who was arrested under the stringent Unlawful Activities (Prevention) Act in connection with the north-east Delhi violence issue. The Delhi Police in its reply opposed the bail plea, stating that the petition is “meritless”. The Karkardooma court adjourned the hearing for August 7 for detailed arguments.

The Delhi police in its reply said that the present case pertains to a larger conspiracy which was registered on 6 March 2020. In total, 21 accused persons have been arrested in the case till date, out of which charge sheet qua 18 accused persons has been filed, including the present applicant. Further investigation in terms of 173(8) Cr.PC is still in progress. The application filled by the applicant has no merit as would be revealed and demonstrated before this court by reference to the charge-sheet filed before this court and as such the prosecution does not seek to file detailed reply to the present application, it added.

The prosecution would demonstrate the “Prima facie” case against the applicant by reference to and relying upon the charge-sheet filed before this court. A supplementary charge-sheet was filed in November last year against Umar Khalid and Sharjeel Imam in a case related to the alleged larger conspiracy in the communal violence in northeast Delhi in February. Khalid was arrested in the case in October last year for allegedly conspiring with suspended AAP councillor Tahir Hussain, co-accused in the matter, to fuel riots in the Khajuri Khas area.

Communal violence had broken out in northeast Delhi on 24 February last year.
