Cops should decide on entry into Delhi: SC on farmers’ Republic Day tractor rally

The Supreme Court on Monday said that it cannot act as the “first authority” to make a decision on whether the protesting farmers should be allowed inside the city and that is the call of the Delhi Police. The top court was hearing a plea by Delhi police seeking an order against the farmers proposed tractor rally on Republic Day, January 26.

The Supreme Court adjourned hearing to Wednesday on the main issue forming of committee to hear farmers and stakeholders on the three contentious farm laws.

During the hearing CJI told Attorney General K.K. Venugopal that who can be allowed or not are matters of law and order will be dealt by police. Does Union of India need Supreme Court to tell what powers ithas under the Police Act? The authorities prohibit then matter come before the court to this challenge, CJI added.

Attorney General Venugopal replied and said this is an extraordinary situation. The CJI said: “But why do you want us to tell what powers you have. We have not taken charge of the matter except one issue. And our intervention is grossly misunderstood.”

Appearing for the Central government, Solicitor-General Tushar Mehta said there are issues to address.

CJI asked: “What happened, are any advocate appearing for farmer unions?” Senior advocate Dushyant Dave replied: “Yes My lord I am appearing.”

The case was, therefore, adjourned and will now be heard on Wednesday.
