Bombay High Court: PIL Moved Seeking To Make Shah Rukh Khan, Son Aryan Khan Accused In CBI’s Bribery And Extortion Case Against Sameer Wankhede

The Bombay High Court in the case Rashid Khan Pathan v. Shahrukh Khan and Ors observed wherein the plea is moved seeking to implead actor Shah Rukh Khan as an accused in the FIR filed by CBI against former NCB Zonal Director Sameer Wankhede and five others with regards to the arrest of Aryan Khan in 2021.
In the present case, the petition stated that the Wankhede was charged by CBI under section 7, section 7A and section 12 of the Prevention of Corruption Act for accepting a bribe for an amount of Rs 50 lakhs to favour Aryan, Shah Rukh Khan’s son.
The court in the case observed and stated that since section 12 of the Prevention of Corruption Act provides for the prosecution and punishment of the person giving the bribe as well, Shah Rukh Khan and his son Aryan should be arraigned as accused for giving the bribe to Sameer Wankhede through co-accused KP Gosavi.
It has also been state din the plea that as per Section 12 of the Prevention of Corruption Act that the person who is giving bribe is also accused of abetment of corruption and is liable for prosecution and punishment.
Further, the petition added while adding the Supreme Court judgement that the transfer of investigation from the CBI to the Special Investigations Team and the action against Mumbai Police Officials who gave a clean chit to Wankhede in an another complaint. Therefore, the prosecution of offender being an obligation of the state.
The present plea is moved by one Rashid Khan Pathan, who claims to be the human rights activist. Thus, he in the case also claims the non-inditement of Shah Rukh Khan is a lapse which being on the part of the CBI with regards to the manner in which the investigation is being conducted. Accordingly, the court listed the matter to be next heard on June 20, 2023.
