Shiromani Akali Dal has demanded immediate disqualification of Cabinet Minister Aman Arora as MLA as he has been awarded two year rigorous imprisonment by a Sunam Court in a case on 21.12.23

In a letter written to Kultar Singh Sandhwan Speaker Punjab Vidhan Sabha on behalf of Akali Dal Legislative Party, Dr. Sukhwinder Sukhi MLA, told him that Aman Arora has been awarded punishment of two year rigorous imprisonment by court of Sub Divisional Judicial Magistrate Sunam on 21.12.23 u/s 148, 323, 452 (read with section 149) IPC in case of Rajinder Deepa vs Aman Arora. He said that Aman Arora has been found guilty on two counts and has been awarded rigorous imprisonment of two years.
He said that Honourable Supreme Court of India in a case Lilly Thomus vs Union of India (along with Lok Parhar vs Union of India) in 2013 had ordered that in case an MLA/MP/PMLC is awarded sentence of two years of more his/her membership will be immediately seized and he/she will be disqualified immediately.

SAD leader further quoted orders of Supreme Court, “The plea through SN Shukla the secretary of NGO alleged that though the law has been settled by the apex court in 2013 judgement that lawmaker stands disqualified on conviction but due to delay in notification on the part of legislative Secretariat the convicted MLAs keep enjoying fruits of the office. It has sought a direction to Registry of all the High Courts that the certified copy of the judgements convicting lawmakers, be made available to legislative Secretariat within 24 hours so that a disqualification notice can be issued at the earliest.”

He said that in light of these directions of the Supreme Court, Aman Arora should be disqualified as an MLA without further delay and notification in this regards should be issued immediately, he urged the Speaker.
