Green Card Holders Rejoice: USCIS Extends Renewal Validity To 36 Months

New Policy Enhances Flexibility for Permanent Residents

The United States Citizenship and Immigration Services (USCIS) has announced an extension of the validity period for Permanent Resident Cards, commonly known as Green Cards, for lawful permanent residents filing Form I-90 to renew their cards. Effective September 10, 2024, the validity extension will increase from 24 months to 36 months, giving applicants more time while they await the issuance of their new cards.

 

Who Benefits from the Extension?

This new extension applies to individuals submitting Form I-90 to renew either an expiring or expired Green Card. Previously, the receipt notices for Form I-90 granted a 24-month extension, but the updated 36-month period provides Green Card holders with greater flexibility during the renewal process.

 

How the Change Supports Green Card Holders

The extended validity period offers significant advantages for Green Card holders, particularly concerning international travel. While lawful permanent residents can leave and re-enter the United States, they cannot remain outside the country for over one year without risking their residency status. If a Green Card expires during an extended absence, the holder may face challenges in reapplying for legal status. With the new 36-month extension, residents can travel with increased confidence that their legal status will remain secure.

Moreover, the extension notice can be used alongside an expired Green Card as proof of legal residency in the United States, which is valid for employment purposes while awaiting the new card. This aspect is especially important for individuals concerned about their ability to work legally during the renewal process.

 

What to Do If You Don’t Have Your Green Card

For those who no longer possess their Green Card and require evidence of their lawful permanent resident status, USCIS advises reaching out to a local Field Office. They can request an appointment through the USCIS Contact Center for proof of status. After submitting Form I-90, individuals may also receive an Alien Documentation, Identification, and Telecommunications (ADIT) stamp.

 

Renewal Timing Guidelines

Green Card holders should be aware of when to file for renewal. If the Green Card is valid for ten years, renewal should be initiated when the card has either expired or is set to expire within the next six months. For conditional residents holding a two-year Green Card, a petition must be filed to remove the conditions, which can be submitted up to 90 days before the card’s expiration. Upon approval, a new ten-year Green Card will be issued, negating the need to file Form I-90.
