BMW crash case: Delhi Court takes cognisance of chargesheet, accused summoned on Feb 2

NEW DELHI: A Delhi Court on Friday took cognisance of the chargesheet filed in BMW accident case.

Judicial Magistrate Ankit Garg of the Patiala House Court took cognisance of the chargesheet and issued summons to accused Gaganpreet Kaur, directing her to appear before the court on February 2.

400-page chargesheet filed by Delhi Police in the court in the case where Navjot Singh (32), Deputy Secretary in the Ministry of Finance, lost his life.

According to the chargesheet filed by the police, after the accident Navjot remained alive for at least 15 minutes, and had timely medical assistance been provided, his life could have been saved.

The chargesheet also alleges that the accused, Gaganpreet Kaur, deliberately delayed providing necessary medical assistance to the victim in time. As a result, Finance Ministry officer Navjot Singh died, chargesheet alleges.

The chargesheet links Gaganpreet to offences under Section 105 (culpable homicide not amounting to murder) of the Bharatiya Nyaya Sanhita (BNS), Sections 281/125II (penalising rash driving of the BNS, and Section 238A (intentionally hidden evidence) of the BNS.

The accident occurred on September 14 at around 1:10 pm, when Gaganpreet’s BMW X5 was being driven at a speed of 100-110 kmph.

The car hit a metro pillar near the Delhi Cantonment Metro Station on Ring Road and then collided with the motorcycle of Navjot Singh, a resident of Hari Nagar.

The chargesheet further states that immediately after the accident, an ambulance with paramedical staff arrived at the spot.

Not only this, despite having only minor injuries, the accused got herself admitted to the ICU of the same hospital in order to avoid police questioning and protect herself from legal action, the chargesheet alleges.
