AAP MP Swati Maliwal arrived at Delhi’s Tis Hazari court for the bail hearing of Delhi CM’s aide, Bibhav Kumar. Senior advocate N Hariharan asserted the maintainability of the bail application, emphasizing the court’s jurisdiction.

Hearing underway for Bibhav Kumar’s bail plea in Swati Maliwal’s case. Here’s his counsel’s statement so far:

  • The ongoing hearing in Swati Maliwal’s case against Arvind Kejriwal’s aide, Bibhav Kumar, has seen arguments from his counsel. The FIR invoked Section 308 IPC, triable by the Court of Session. Senior advocate Hariharan contended that Maliwal visited the CM’s residence and contacted the PA, but Kumar was absent. He questioned Maliwal’s entry into the CM’s residence, arguing against such access to an official premises.
  • Bibhav Kumar’s counsel accused Maliwal of premeditated actions before entering the CM’s residence, highlighting her lack of mention about being called by the CM. He questioned whether being an MP granted permission for such actions and cited security statements regarding her entry.
  • The senior advocate argued that there was trespass and a report was filed, emphasizing Maliwal’s lack of appointment or prior notification of her visit. He referred to a report where Maliwal questioned security personnel about keeping an MP waiting and stated that she waited in the waiting room, asking security to speak to Bibhav Kumar.
  • The advocate contended that Maliwal’s claims in the FIR were false and not based on an immediate complaint, as the FIR was lodged three days later. The accused sent a complaint through email on May 17, Advocate Khurana submitted.
