Supreme Court: If Filing Defects Are Not Cured Within 4 Weeks; Court To Dismiss Over 1000 Cases Filed Between 2014-2020

The Supreme Court in the case Brig. T. S. Sathyamoorthy vs. Govt. of India & Ors. observed and by an order granted a last opportunity to the advocates on record for curing the defects of one thousand odd petitions being filed before the apex court. In an order it was stated that the batch of petitions that were filed before the apex court between the year 2014 to 2020 were sent back to the Advocates on Record for rectification and for refiling but still the rectified copies are not received by the Registry.

The Single judge bench comprising of Justice P. S. Narasimha observed while hearing of the matter in chamber, wherein directing the respective Advocates on Record to cure the defects in the petitions and re-file them within a period of four weeks or else the case would stand dismissed by the court. As a last opportunity, the court granted further time of 4 weeks from today to cure the defects and failing which the cases shall stand dismissed without any further reference to the court.

The order stated clarifies that despite of sending repeated reminders to the counsels the petitions were not sent back to the registry after the defects were cured. The bench of Justice Narasimha allowed 23 petitions from the batch of petitions to be withdrawn. The registry also directed to re notify 18 matters after verification, if necessary.

Accordingly, the Supreme Court had last month by an order scrapped 13,147 pre-2014 cases which are being remained with uncured defects.
