Supreme Court Heard Plea Moved By Rahul Gandhi To Stay Conviction In Defamation Case Over Remark Of ‘Modi Surname’

The Supreme Court in the case Rahul Gandhi v. Purnesh Ishwarbhai Modi & Anr. observed and has issued notice on the plea moved by Congress leader and former Member of Parliament, MP Rahul Gandhi wherein seeking suspension of the conviction of him in the criminal defamation case over ‘Modi thieves’ remark, which in the case resulted in the disqualification of him from the Lok Sabha.
The bench comprising of Justice BR Gavai and Justice Prashant Kumar Mishra in the case observed wherein the plea is moved by Gandhi wherein it challenged the Gujarat High Court’s refusal to stay the conviction of him in the case of criminal defamation.
The bench headed by Justice Gavai stated that his father was associated with the congress and the brother is still associated with the party and has asked if there being any objection raised to him.
The counsel, Senior Advocate Dr.Abhishek Manu Singhvi, appearing for Rahul Gandhi and the counsel, Senior Advocate Mahesh Jethmalani, appearing for the complainant, stated before the court that they had no objection and that is being fair comment to make that Singhvi commended the judge.
The Senior Advocate Singhvi also requested before the court while considering the facts and circumstances of the case that Rahul Gandhi has lost over the hundred days as the Parliament member which includes one entire session and a part of the ongoing Monsoon Session which is set to end on August, 11 and that the bye-elections for the Wayanad constituency could be notified soon.
In the present case, Rahul Gandhi approached the Supreme Court wherein it challenged the order of Gujarat High Court dismissing the application moved by him to stay the conviction in the criminal case. Thus, the conviction made in the present case led the disqualification as a Member of Parliament.
Therefore, Jethmalani requested ten more days’ time for filing of the reply.
Accordingly, the court listed the matter for further consideration on August 04, 2023.
