Supreme Court Collegium Recommended The Appointment Of One Judicial Officer As The Judge Of Calcutta High Court

Supreme Court Collegium Recommended The Appointment Of One Judicial Officer As The Judge Of Calcutta High Court

The Supreme Court Collegium has recommended the Judicial Officer, name of Smt. Chaitali Chatterjee, Das, for appointment as Judge of the Calcutta High Court.

The Supreme Court Collegium bench comprising of Chief Justice of India DY Chandrachud, Justice Sanjiv Khanna and Justice BR Gavai has approved the recommendation made by the High Court collegium in September last year.

The Supreme Court Collegium bench noted that the Chief Minister and the Governor for the State of West Bengal have not conveyed their views on the above recommendation.

Therefore, the Department of Justice forwarded the above recommendation by invoking para 14 of the Memorandum of Procedure wherein it is provided that if the comments of the constitutional authorities in the State are not received within the prescribed time-frame, thus, it should be presumed by the Minister of Law and Justice that the Governor and the Chief Minister have nothing to add to the proposal and proceed accordingly.

The Supreme Court Collegium bench consulted the three judges of the Supreme Court who were conversant with the affairs of the Calcutta High Court.

Further, the Collegium bench of all the three judges stated that all the candidate is suitable for being appointed as a High Court Judge.
