Supreme Court: CBI Seeks Listing Of Plea Against Bail Granted To Lalu Prasad Yadav In Fodder Scam

The Supreme Court in the case State of Jharkhand V. Lalu Prasad @ Lalu Prasad Yadav, SLP observed and has agreed to list the appeals moved by the Central Bureau of Investigation wherein it challenged the bail granted by the Jharkhand High Court to Rashtriya Janata Dal, RJD the Chief Lalu Prasad Yadav in the Fodder Scam Cases on August 25, 2023.
The matter was listed for early hearing before the bench comprising of Chief Justice DY Chandrachud and Justice Sanjay Karol and Justice Manoj Misra by the counsel, Additional Solicitor General, SV Raju appearing for the CBI.
Facts of the Case:
The Jharkhand High Court in the case observed and has granted bail in the case which relates to the fraudulent withdrawal for an amount of Rs 3.13 crores from Dumka Treasury on the ground that he has served half of his prison term on April 17, 2021. Therefore, the said court also convicted him in the case of four fodder scam which pertains to fraudulent withdrawal of money from Deoghar, Dumka and Chaibasa treasuries in Jharkhand. In 2019 he was granted bail in the Deoghar treasury matter.
However, the court also convicted him in two cases which being for fraudulent withdrawals from the Chaibasa Treasury and he in the case was also granted bail in the Chaibasa Treasury matter by the Jharkhand High Court which being on the ground that he had undergone half of the sentence which is being imposed on him om October 09, 2020.
Further, the Prasad was in jail after the conviction of him in three fodder scam cases. Thus, he in the case secured bail in the four cases related to Dumka, De eoghar and Chaibasa treasuries
Therefore, the RJD chief has also been convicted and has sentenced him to five years in prison and a fine is imposed for an amount of Rs. 60 lakhs by the Special Court in Ranchi, for a fifth fodder scam case which pertains to the fraudulent withdrawal of Rs. 139.35 crores from Doranda Treasury in February this year.
The Jharkhand High Court granted him bail in respect to the 5th case this year in the month of April.
Accordingly, the court listed the matter for further consideration on August 25, 2023.
