The Supreme Court in the case Delhi Development Authority v. Jagan Singh observed while taking the serious view of vendors who are encroaching upon the pavement which was built on a land which was compulsorily being acquired from a citizen for the public purpose. The court in the matter called for necessary action by the Delhi Development Authority.
The bench comprising of Justice Abhay S Oka and Justice Sanjay Karol in the case observed wherein the appeal is filed by the Delhi Development Authority in the matter which relates to land acquisition for the Kalindi Kunj Metro Depot.
The bench in the case observed and has notice while deciding the appeal from the photographs that the pavement near the metro depot has already been occupied by the car clinic and the other vendors.
The court while taking a serious view of the matter stated that the land was compulsorily being acquired from a citizen who is being encroached upon.
The bench in the case observed that the citizen has lost his valuable property by way of compulsory acquisition. Therefore, the compulsory acquisition has been made for the public purpose and thus, the appellant and all the concerned authorities cannot be allowed for the pavement to be used for any purpose except for allowing people to walk.
The court observed and stated that the said court hope and trust that either the appellant takes immediate action on this behalf or calls upon the authorities empowered for taking the action to do the needful immediately in accordance with the law.
