Plea Moved In Kerala High Court Challenges Decision Of Transport Authority’s To Implement Uniform Color Code On All Ambulances

The Kerala High Court observed wherein the plea is moved by the charitable trust to the own a fleet of ambulances and the decision of to implement uniform colour code on all ambulance vehicles in the State.
The court in the case observed that all the new new ambulances in Kerala are painted white and comply with other stipulations with effect from January 01, 2023. So the authority has decided as far as the old ambulances are concerned for implementing the colour code on them as and when the vehicle is produced for renewal of fitness certificate.
It has also been stated by the petitioner-Trust that the transport Authority is not vested with any power to prescribe a uniform colour code or scheme to Ambulance vehicles under the Motor Vehicles Act, 1989 or the corresponding Rules.
It has also been contended before the court that the Authority has not backed its “unilateral decision” with any reasons.
The Single bench headed by Justice Murali Purushothaman in the case observed and has adjourned the matter.
It being the case of the petitioner that it mandated the uniform colour code for ambulances would preclude the inclusion of sponsor details on the vehicles and consequently, discourage charitable trusts and other entities from sponsoring ambulances.
Further, it has also been submitted before the court that while private players are precluded from painting any details on ambulance body, government-owned KSRTC buses are permitted to do the same.
The petitioner in the plea averred that the action is per se discriminatory and in contravention of Article 14 of the Constitution of India.
The counsel, Advocates P.A. Mohammed Shah, Renoy Vincent, Shahir Showkath Ali, Chelson Chembarathy, Muhamed Junaid V., and Shilu Sebastia moved the petition.
