Patna High Court: Plea Dismissed Seeking Construction Of Civil Court Building In Shahpur Patori

The Patna High Court in the case Rajesh Kumar Singh vs The State of Bihar and Ors observed and has dismissed the plea seeking construction of a Civil Court building in the city’s Shahpur Patori area in the Samastipur district.
The Division bench comprising of Chief Justice K. Vinod Chandran and Justice Rajiv Roy in the case observed and has stated that there is no public interest discernible from the aforesaid prayers made which is almost in the nature of seeking information for which there being adequate remedies available as stated under the Right to Information Act, 2005.
In the present case, the plea is moved by one Rajesh Kumar Singh, who also challenged the proposal of the Circle Officer of Patori and also sought for implementation of any other proposal beneficial to the people of Shahpur Patori area.
The Court while dismissing the plea in limine stated that the said court is not convinced that there could be any such claim made in public interest, especially when the High Court is in seisin of the need of infrastructure of the District Courts.
The court in the case observed and has stated that the land for construction of court complexes are firstly identified by the local inspection which is to be conducted by the District Judge and the District Magistrate upon which a proposal is sent either to the Law Department or to the High Court.
Further, it has been stated by the said court that the Infrastructure Committee of Judges appointed in the High Court will then considers the proposal and then with appropriate consultation with the Law Department and the Building Construction Department it will approve the identification of the plot and the construction of building for the purpose of establishment of Courts.
