Madhya Pradesh High Court: Takes Suo Motu Cognizance Of Death Of Children In Open Tube-Wells

The Madhya Pradesh High Court in the case In Re (Suo Motu) v. The State of Madhya Pradesh and Ors observed and tool the suo motu cognizance of the deaths of children in the open tube-wells.
The Division bench comprising of Chief Justice Ravi Malimath and Justice Vishal Mishra in the case observed and stated that the said matters pertain to the unfortunate death of children in the open tube-wells which being throughout the state of Madhya Pradesh.
The court in the case observed and has stated that the said plea has been registered as the suo motu proceedings which are based on the various publications made in
the daily newspapers.
In the present case, the three-year-old girl fell into a 300-feet deep open borewell and got stuck at around 40 feet and she further slipped down to a depth of 100 feet due to the vibrations caused by the machines used for her rescue, in the Sehore district of Madhya Pradesh on June 06, 2023. Therefore, she in the case was being pulled out of the borewell in an unconscious state and
was declared dead.
It has also been stated by the court that as per the media reports, more than half-a-dozen incidents of children falling into open borewells, and some of the children are dying, thus, which have occurred in one year in the State of Madhya Pradesh.
