Kerala High Court: Dismissed Anticipatory Bail Pleas Of Principal, SFI Leader; Kattakkada Christian Collections Row

The Kerala High Court in the case Shyju G.J. v. State of Kerala and Visakh A. v. State of Kerala observed wherein the anticiparatry bail plea was moved by the former Principal of Christian College, Kattakada, G.J. Shyju, and Student Federation of India, SFI the leader Visakh A in the case related to alleged impersonation, falsification of documents and misrepresentation during the college elections which were held in May 2023.
The bench headed by Justice Bechu Kurian Thomas was hearing the present case.
The bench was informed that the accused in the case were willing to surrender before that the investigating officer on 04.07.2023, wherein the court directed that the two of the petitioners are surrendered before the IO on or before 04.07.2023, thus, they shall be subjected to interrogation, and thereafter, the procedure as contemplated under law shall be complied with.
Therefore, the Principal of the College, who has been named as the first accused person, was allegedly to have committed the certain malpractices during the conduct of the college elections.
Further, the court observed that the 2nd accused person, Visakh A., who being the 20 year old B.Sc. Physics student, averred before the court that he had been arrayed as an accused in the case by the police without conducting proper enquiry, and added that there were no elections conducted in the college, since the five candidates were being selected unanimously, de hors their political affinity.
Further, it has been submitted before the court that that when one of the candidates became medically dispossessed, she voluntarily resigned and no elections were held in the college, therefore, the Principal of the College forwarded his name as one of the representatives.
The counsel, dvocate Sasthamangalam S. Ajithkumar appeared for the Principal of the College.
The counsel, Advocate S. Nikhil Sankar appeared on behalf of the 2nd accused, Visakh.
