Karnataka High Court: Lawyer sent to jail for one week for making ‘Wild Allegations’ against Judges & Judicial System

The Karnataka High Court in the case High Court of Karnataka And K S Anil observed and has directed an advocate to be taken into judicial custody for a week for contempt of court. The division bench comprising of Chief Justice Prasanna B Varale and Justice Ashok S Kinagi in the case observed and has passed the order in a suomotu contempt which is being initiated in 2019 on February 2 against the advocate K S Anil. The bench stated that this court is left with no other option except for passing an order to take the accused into judicial custody for committing contempt of Court.

It has also been directed by the court that Anil is to be taken into judicial custody for a period of one week and is to be produced before it on the next date of hearing, which is being February 10. The court noted that the accused, who being presently before the court, firstly it has been argued that the earlier notice issued to him was not properly served. On the other hand, he made submissions that the said observations made in the order dated January 13, 2023 are not in consonance with the events that had occurred on that day. The bench also perused the memo-cum-written submissions made which are being filed by the accused urging it to transfer the matter to some other bench as the complaint has been filed by him against the Chief Justice and the sitting Judge before Chief Justice of India and Department of Justice and others, wherein accusing them of making wrong entries in order sheets.

It has been stated by the division bench that certain derogatory statements are being made in the said memo and it has been asked to the lawyer about the other details such as the date of the order etc, to which he replied wherein stating this order is available on the website of the High Court. The court observed that the statement which are made by the accused wherein allegation are made against the judges clearly shows that the accused is having no regards to the judicial system. However, the said accused being a practising advocate and is consistent behaviour of the accused on the earlier occasions and today he is making wild allegations against the judicial system and the Judicial Officers in particular indicating that he is trying to demean the institution and is lowering the image of the judicial system in the public eye.
