The Manipur High Court in the case Deeksha Dwivedi v. State Of Manipur And Ors observed and has extended the interim protection granted to Advocate Diksha Dwivedi till September 13, 2023, against whom an FIR was lodged after she took part in a fact-finding mission with regards to the Manipur violence.
The bench comprising of Justice Guneshwar Sharma observed and has stated that the State government filed its counter affidavit in the matter.
Further, the court in the case observed and has granted two weeks’ time to Respondent no. 3 for filing its counter affidavit in the matter.
In the present case, Dwivedi, who has been booked for Sedition, Conspiracy to wage war against India, etc., had earlier moved the Supreme Court, wherein the court granted her interim protection from arrest and liberty to approach the High Court.
The court granted Dwivedi the liberty to file a rejoinder in the matter..
The counsel appearing for Dwivedi submitted before the court and urged that it would be difficult to approach the Manipur High Court in view of the situation prevailing there.
The bench comprising of CJI DY Chandrachud, Justice PS Narasimha, and Justice Manoj Misra granted her liberty to appear before the High Court virtually.
Therefore, the Supreme Court in the case was then informed that both Dwivedi and her instructing counsel were receiving online threats.
The Supreme Court in its order stated that, you have the liberty to approach in case of any grievance.
However, she moved before the High Court on August 01, 2023 and the High Court in the case observed and has issued the notice in the matter while extending interim protection till August 17.
Accordingly, the court listed the matter for further consideration on September 13, 2023.
