High Court Directed Delhi Govt, MCD: Close Down Coaching Centers Operating Without NOC From Fire Department

The Delhi High Court in the case observed and has directed the Delhi Government and Municipal Corporation of Delhi to close down the coaching centres which are operating in the national capital without a no objection certificate, NOC from the Fire Department,
The Division bench comprising of Chief Justice Satish Chandra Sharma and Justice Saurabh Banarjee in the case observed and has asked the Delhi Fire Services and other authorities to provide the logistical support to the civic body for the compliance of the order within the period of 30 days.
The court in the case observed and has stated that the provisions of Delhi Master Plan, 2021, wherein it permit the coaching centres to operate and which being subject to the conditions which are mentioned therein and that fire safety is a must.
In the present case, the bench was hearing the suo motu case initiated in the month of June after fire broke out at a coaching institute in city’s Mukherjee Nagar. Therefore, an FIR was also registered in Mukherjee Nagar as stated under section 336, the Act endangering life or personal safety of others, Section 337, Causing hurt by act endangering life or personal safety of others, Section 338, Causing grievous hurt by act endangering life or personal safety of others, Section 120B, criminal conspiracy and Section 34 of the Indian Penal Code, 1860 after the fire incident.
Further, the court in the case observed and has directed the Fire Services Department to examine the fire certificate and building sanction of all coaching centres in Delhi.
Therefore, the status report has been filed by the Delhi Police before court submitted that only 67 of the total 583 coaching institutes in Delhi have requisite the NOC from the Delhi Fire Services.
It has also been stated in the status report filed that as per the reports which are received, there being total 583 coaching institutes are running in Delhi, out of which 67 institutes are having Delhi Fire Service certificate, whereas 516 institutes are not having any kind of certificate.
Accordingly, the court listed the matter to be next heard on October 10, 2023.
