The Gujarat High Court, in a bid for enhancing the case management and in order to ensure expeditious proceedings, has notified a new circular which is being titled ‘Methodology for Ensuring Next Listing Date in All Cases Pending’. The said initiative taken aims to streamline the handling of registered matters and to prevent cases from languishing without the future listing dates. The circular issued approved by the Chief Justice and Judges of the Standing Committee of the High Court of Gujarat, wherein seeking to address the issue of cases being adjourned without a future listing date. Therefore, under the new approach, the cases that lack a future listing date upon adjournment will have a date automatically generated and is allotted by the system. The circular issued clarified the pending cases appropriately wherein it classified them into three age-based categories: Cases that have been pending for over the period of 10 years: Critically the Old Cases Cases that are pending for more than 5 years but up to 10 years: Old Cases Cases that are up to 5 years old: Not So Old Cases However, the criteria for allotting System Generated Next Listing Date has been devised based on these age categories of the matters. Thus, all the other practices and protocols concerning the listing of cases will also be implemented in accordance with the enclosed methodology, which is starting from 01.09.2023.
