Delhi High Court: Refused To Give Shorter Date In Case Of NI Act Citing ‘Pendency Of More Than 8800 Cases’ Before Judge

The Delhi High Court in the case observed and has refused to give shorter date citing ‘pendency of more than 8800 cases’ before it. The court listed the case for next hearing on November 22 under the Negotiable Instruments Act, 1881.
However, the Metropolitan Magistrate Aishwarya Sharma of Saket Courts in its order passed on April 24, 2023 stated that shorter date is being requested and thus, the same is not possible as the said court has the pendency of more than 8800 cases.
In the present case, the court was hearing a case registered under the Negotiable Instruments Act, 1881 by an entity namely City One Travels Private Limited which being against a private individual in the year 2021. Therefore, the bailable warrants are being issued against the accused persons.
Therefore, the court during the hearing noted that the bailable warrants were received back and the same is unexecuted with the report of the house owner wherein it is stated that the accused did not reside there. Further, it has been stated by the owner that she had purchased the house in question eight years back.
The court in the case observed and has issued the bailable warrants afresh on filing of correct address, or alternatively upon filing of an affidavit with regards to the physically verified address of the accused within a period of eight weeks.
Accordingly, the court listed the matter to be next heard on November 22, 2023.
