Delhi High Court: Interim Bail Granted To Former Rajya Sabha MP Vijay Darda, Son In Coal Scam Case

The Delhi High Court in the case Vijay Darga v. Central Bureau Of Investigation observed and has granted interim bail to former Rajya Sabha MP Vijay Darda, his son Devender Darda and businessman Manoj Kumar Jayaswal who were recently convicted and was being sentenced to four years of imprisonment in a coal scam case.
The bench headed by Justice Dinesh Kumar Sharma in the case observed and has issued the notice on the petition moved by Dardas and Jayaswal against the trial court order convicting and sentencing them in the case.
The court in the case observed and seek response of the Central Bureau of Investigation and directed the probe agency to file its response within the period of eight weeks.
However, the court convicted Dardas and Jayaswal in the case which relates to irregularities in the allocation of a coal block in Chhattisgarh. It has also been observed by the trial court that they obtained the block by cheating the government.
Further, the trial cour tin the case also awarded three years of sentence to former coal secretary H C Gupta and two other other former officials namely K S Kropha and K C Samria. The court granted bail to three individuals by the special judge for enabling them to challenge the conviction of them before the High Court.
The Trial Court in the case observed and has held that the accused persons guilty of criminal conspiracy, Section 120B and of Cheating, Section 420 under the Indian Penal Code, 1860 and the other offences under the Prevention of Corruption Act.
The court in the case observed and has imposed the fine for an amount of Rs. 50 lakhs on JLD Yavatmal Energy Pvt Ltd, the entity which was also being convicted in the matter.
The court also imposed a fine of Rs. 15 lakhs each by the special judge on the Dardas and Jayaswal. Thus, the other three convicts were directed to pay the fine for an amount Rs. 20,000 each.
