Delhi High Court: Granted Interim Bail To Former Congress MLA Accused of Misbehaving with Cop, Asking Him to Offer Services at Education Centre

The Delhi High Court in the case Asif Mohammad Khan v. State observed and has granted interim bail to former Congress MLA Asif Mohammad Khan who being accused for allegedly misbehaving with a police officer, wherein subject to the condition that the services will be offered by him at an adult education centre.
The bench headed by Justice Dinesh Kumar Sharma noted that Khan being in an alumni of Jamia Millia Islamia University and has directed him to offer the service thrice a week.
In the present case, the FIR was being registered by Delhi police at Shaheen Bagh police station under section 353 (assault or criminal force to deter public servant from discharge of his duty), section 341 (wrongful restraint), section 186 (obstructing public servant in discharge of public functions) and section 153 A (promoting enmity between different groups) of Indian Penal Code, 1860.
However, the court was hearing a plea moved by one Khan after he was recently being denied bail by a trial court. Khan was being accused for allegedly misbehaving with the police officer in the Shaheen Bagh area. On January 05, he was being arrested. It has also been asked by the bench of Justice Sharma to Khan to mark his presence before the SHO of the concerned police station every alternate day. It has also been directed by the court to him to let go to the police station “without his supporters.”
Adding to it, the court also asked khan to approach the member Secretary of Delhi State Legal Service Authority for rendering his service at an adult education Centre which is run by a recognized NGO, which being three times a week for two hours.
It has also been clarified by the court that this being the case wherein Khan is found indulging in a similar offence, the State shall not be at the liberty for seeking cancellation of the interim bail.
