Delhi High Court Asks Delhi Govt To Frame Policy; Ordered Release Of End Of Life Vehicles, Subject To Undertakings By Owners

The Delhi High Court in the case observed and has ordered the release of various end of life vehicles which being subject to an undertaking being furnished by their owners that such vehicles will not be plied or will be parked in public spaces or that they will be removed from the territory of national capital.
The bench headed by Justice Prateek Jalan in the case observed and has also asked the Delhi Government to frame a policy to deal with similar vehicles in cases where the owners are ready to give an assurance that the vehicles will not be used in the national capital.
Therefore, the Delhi Government’s transport department has been seizing and scrapping petrol and diesel vehicles which are older than 15 years and 10 years respectively, as per the orders of the National Green Tribunal, NGT.
In the present case, the court was hearing the batch of plea moved challenging the action of seizure of various cars by the Delhi Government authorities for being in violation of the judicial orders.
It has been stated by the bench of Justice Jalan that the grievances of the petitioners can be balanced if the orders passed by the National Green Tribunal and the Supreme Court are implemented by directing ordering release of the end-of-life vehicles to their respective owners, which being subject to them furnishing an undertaking that such vehicles will be removed from the territory of Delhi’s and that they will not be plied or parked in public spaces here.
The court also stated in the case the concerned Enforcement Officer will facilitate the release of the vehicles in question, which are owned by the petitioners, from the scrapping agency.
Adding to it, the court stated that any breach of the undertaking by the petitioner-owners would invite action from the court.
It has been directed by the Delhi’s transport minister Kailash Gahlot that the transport department to stop seizing and scrapping end of life vehicles which are parked along the roads and are not plying.
