Allahabad High Court Cancels Bail Of MLA Raju Pal Murder Case Accused: ‘Writ Of Atique Runs In Police Station Area, Not Of Govt

The Allahabad High Court in the case Krishna Kumar Pal @ Umesh Pal vs. State Of U.P. And 2 Others observed while granting a bail to an accused (Farhan) in the 2005 murder of then BSP legislator Raju Pal in Prayagraj, wherein the court stated that in the area of the Police Station Dhomanganj or Dhoomanganj, Prayagraj the writ of the State Government does not run and rather, the writ of the dreaded criminal, Ateeq Ahmad runs.
The court also noted that both Raju Pal and the Umesh Pal, who being the star witness of the murder case, (being killed last month) were being eliminated by assailants who were acting allegedly at the behest of Former MP Atique Ahmed.
The bench comprising of Justice Dinesh Kumar Singh in the case observed that one star witness of Raju Pal’s case got eliminated in a most gruesome and dare-devil manner allegedly by Ateeq Ahmad and his gangmembers in an incident of broad-day-light. Thus, all the offences were being registered at Police Station Dhomanganj, Prayagraj. It is being appeared to the court that in the area of Police Station Dhomanganj, writ of the State Government does not run, rather writ of dreaded criminal, Ateeq Ahmad runs.
In the present case, the bail cancellation plea was filed by one Umesh Pal (who was killed last month) wherein the court observed that Accused Farhan is a hardened criminal who belongs to one of the most dreaded gangs of Uttar Pradesh which is being led by the accused, Ateeq Ahmad. It has also been noted by the court that after he was set at liberty of geniting bail by the trial Court in the murder case (wherein Sitting MLA Raju Pal and his two Security Guards were also being killed in a broad-day-light), wherein he also committed one offence after another of heinous nature. Allahabad High Court in the year 2005 granted bail to accused Farhan by the Session Judge, His name appeared as accused in 25 cases, including three offences under Section 302 IPC, three offences under Section 364 IPC, two offences under Section 307 of Indian Penal Code, 1860 and the offence under Section 376-D of the Indian Penal Code, 1860. The court observed that he not only violated the terms and conditions of the bail but he has also been involved in several offences which includes three cases of murder. Accordingly, the court cancelled his bail.
The counsels, Rakesh Dubey, Praveen Kumar Pandey, Sanjay Kumar Yadav appeared for the Applicant. The counsels, G.A., Gyan Prakash, Imran Ullah represented the opposite party.
