The Supreme Court said on Monday that it will hear a petition challenging an order from the Allahabad High Court. This order had transferred all matters related to the Sri Krishna Janmabhoomi-Shahi Idgah dispute to the high court from a Mathura court.
The petition, filed by the Committee of Management Trust Shahi Masjid Idgah, challenged the high court’s May 26 order.
The case came up for hearing before a bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia.
On October 3, the apex court had directed the high court’s registrar to provide information about the suits to be transferred in accordance with the May 26 order.
During the brief hearing on Monday, the bench was informed that an affidavit had been filed on behalf of the high court.
The apex court bench sought to review the affidavit and to understand the high court’s perspective.
The matter was scheduled for a hearing on November 10.
In July, while hearing the case, the Top Court said, “On hearing counsel for parties, we consider it appropriate that the registrar of the high court should forward to us as to what are the suits which are sought to be consolidated by the impugned order as there appears to be a little generality to the directions issued.”
In Mathura, Bal Krishna through Hindu Sena chief Vishnu Gupta and others had filed a suit in the court of Civil Judge Senior Division (III) for shifting of the Shahi Masjid Idgah, which they claim was constructed on a part of the 13.37 acre land of the Sri Krishna Janmabhoomi Trust.
On May 26, the high court transferred all matters related to the Sri Krishna Janmabhoomi-Shahi Idgah dispute from the Mathura court to itself. This decision was made while allowing a transfer application filed by Bhagwan Shrikrishna Virajman at Katra Keshav Dev Khewat Mathura (deity), represented by Ranjana Agnihotri and seven others. The petitioners requested that the high court conduct the original trial, similar to the Ayodhya Babri Masjid-Ram Janmabhoomi title dispute.
