The Karnataka High Court in the case Chetan Kumar And Union of India & others observed and has extended the interim stay of it on an order passed by the Union Government cancelling the Overseas Citizen of India card, OCI which is being issued to the Kannada actor and social activist, Chetan A Kumar.
The Single judge bench headed by Justice M Nagaprasanna in the case observed and was being informed by the petitioner that in compliance with the earlier order of the court, thus, he has deleted the tweets wherein it is alleged against the judiciary and matters that are sub-judice. Thus, the court in its order dated April 21 stayed the order of the Union Of India.
Therefore, in the said case the Kumar had approached the court after the Union government cancelled the OCI card involving Rule 35(2) of the Citizenship Rules, 2009 on the allegation that Kumar had made indulged himself in anti-India activities.
In the present case, the court issued the FRRO, Bureau of Immigration the show cause notice to him asking why his OCI card should not be cancelled, wherein it has been alleged that he was involved in the criminal activities causing hatred and disharmony against the communities in the state and the card seek to be cancelled, invoking Section 7D(b) and 7D(e) of the Citizenship Act, 1955. Accordingly, the court granted the two weeks time to the respondents in order to file their statement of objection and posted the matter to be next heard on June 20.
