The Karnataka High Court in the case ABC AND XYZ observed and has granted interim relief to the daughter of a former High Court judge, enhancing monthly maintenance which is being payable to her by her husband to Rs. 1.5 lakh.
The single bench headed by Justice M Nagaprasanna in the case observed that when the husband is or has been in the realm of luxury lifestyle, thus, the wife and the son of them cannot be left in the lurch.
The court in the case observed and has rejected an appeal preferred by the husband wherein challenging the family court order directing him to pay Rs 75,000 per month to his wife.
Further, the court allowed the plea moved by wife wherein seeking enhancement of maintenance. The Karnataka High Court recently granted relief to the daughter of a former High Court judge, enhancing monthly maintenance payable to her by her husband to Rs. 1.5 lakh.
The court in the case observed and has reiterated that maintenance payable to wife is not for mere existence and if the husband has been living a good life and the wife cannot be asked to lead a life which is lower, Due regard should be had to certain relevant.
Accordingly, the court stated that the wife would also be entitled to educational expenses of the child and litigation expenses, apart from being the enhanced maintenance.
