P.K. Pole, the Chief Electoral Officer (CEO) of Jammu and Kashmir, emphasized on Tuesday that any breach of the Model Code of Conduct (MCC) during the upcoming elections in the Union Territory would be met with appropriate action to ensure a fair and transparent electoral process.
In an exclusive conversation with IANS, Pole reiterated the Election Commission’s commitment to conducting elections in a manner that upholds the principles of democracy, stressing the need for both political parties and the administration to adhere to the MCC guidelines diligently.
Highlighting the importance of the MCC, Pole outlined the key “Do’s and Don’ts” to be followed during election campaigning. He emphasized that provocative or inflammatory statements aimed at inciting hatred, disharmony, or ill will among the public, as well as attacks on the personal character of political rivals, are strictly prohibited and punishable under relevant laws.
Expressing concern over the decline in the quality of political discourse, Pole condemned speeches targeting the judiciary, national integrity, religion, caste, and community. He warned that such rhetoric, which exacerbates social divisions, would be met with immediate and appropriate action.
To prevent violations of the MCC, Pole highlighted the possible penal actions under various laws, including the Representation of the People Act, 1951, and sections of the Indian Penal Code (IPC) that safeguard national integration and harmony.
Pole emphasized that freedom of speech, while guaranteed by the Constitution, must be exercised responsibly and within the boundaries of decency and morality. He cautioned that candidates promoting enmity or mouthing against the integrity of the country or judiciary risk disqualification. In cases of repeated violations, Pole mentioned that the Commission has the authority to derecognize political parties under relevant provisions.
When questioned about the mechanisms in place to ensure compliance with the MCC, Pole revealed that stringent surveillance measures, including videography of public events, would be implemented to monitor adherence to guidelines. He emphasized the importance of obtaining permission for public programs and warned of legal action against those who flout regulations.
