In a major development related to the Swati Maliwal case, Delhi HC declares Arvind Kejriwal’s aide Bibhav Kumar plea maintainable on Monday.
This plea challenges the arrest of Kumar made in connection with swati maliwal assault case. Following Justice Swaran Kanta Sharma’s judgement, a notice was issued to Delhi police.
Meanwhile Delhi Police’s Advocate Sanjay Jain opposed Kumar’s plea on the grounds that he did not disclose his previous plea to trial court, which was later rejected.
But Kumar in his plea alleged that his arrest violates section 41A of CrPC (notice to appearance before police officer).
Earlier, Bibhav Kumar was arrested on May 18 in connection with maliwal’s assault case. Following his arrest, he was sent to Police custody for 5 days magistrate court.
Later on May 24, he was sent to judicial custody for four days. After that, he was sent to police custody for three days.
Also an FIR is also lodged against Kumar under appropriate sections of IPC (Indian Penal Code) which include charges like criminal intimidation, assault or culpable homicide etc.
