SC to Review Seeking Jammu and Kashmir Statehood Restoration

Supreme Court to hear plea on August 8 seeking restoration of Jammu & Kashmir’s statehood; political heat builds as Congress plans August 5 protest.

Deputy Chairman of the Rajya Sabha, Harivansh, announced from the Chair that 34 notices were received today under Rule 267. He noted a rising trend of such notices being submitted daily, many of which fail to specify the rule intended to be suspended a mandatory requirement under Rule 267. Additionally, several notices are missing properly formatted motions. He further pointed out that the detailed guidelines issued by the Chair on 8th and 19th December 2022 are not being adhered to.

Former Union Minister Saifuddin Soz, marking six years since the abrogation of Article 370, stated that the government erred in revoking it. He asserted that the people of Kashmir will persist in their struggle to restore Article 370 through democratic means.

SC Sets the J&K Statehood Plea for Hearing on August 8th

The Supreme Court will hear a new prayer seeking directions to the Center to restore Jammu and Kashmir’s statehood on August 8. This plea was filed by means of a Miscellaneous Application in its concluded case on Article 370, which was mentioned before Chief Justice of India BR Gavai and was content not to remove it from the cause list.

The application comes almost a year after the Constitution Bench upheld the decision of the Centre to abrogate Article 370 that granted special status to Jammu and Kashmir. However, it had refrained from commenting on the constitutionality of the Jammu and Kashmir Reorganisation Act, 2019, which bifurcated the region into two Union territories. Instead, it relied on the Solicitor General’s assurance that “statehood would be restored as early as possible.”

However, to the petitioners, Zahoor Ahmed Bhat and Khurshaid Ahmad Malik, there has been no tangible step in the past 11 months, even after the December 2023 verdict. They are represented by Advocate-on-Record Ejaz Maqbool in this regard.

Political Pressure Mounts Ahead of Hearing

This petition has also coincided with rising political pressure. The Congress party announced plans to observe August 5, the anniversary of the Article 370 revocation, as a black day and will spearhead the protest demanding the restoration of statehood to J&K.

Adding fuel to speculation, several high-level meetings took place in New Delhi on Monday. These include the meet involving Home Minister Amit Shah, NSA Ajit Doval, IB Chief Tapan Kumar Deka, and Home Secretary Govind Mohan. NDA MPs will join another discussion on Tuesday morning, and Prime Minister Modi and President Murmu also met separately that same Sunday.

While the details are officially shut now, many speculations have come into the picture about the promised restoration of statehood by the Centre soon.
