Mirwaiz Umar Farooq challenges house arrest in HC

Hurriyat Conference chairman Mirwaiz Umar Farooq has filed a petition in the Jammu and Kashmir High Court contesting his ongoing house arrest, according to a statement from the separatist amalgam on Wednesday. The court is set to hear the petition on Friday.
The Hurriyat has claimed that Mirwaiz has been under house detention for the past month, with his movements severely restricted. In contrast, the J&K administration asserts that he is a free individual, although security agencies dictate his movements due to safety concerns.
“The hearing of the case regarding Mirwaiz’s house arrest and illegal detention is scheduled for October 4 in the High Court. The Mirwaiz has been under house detention for the last one month,” the Hurriyat spokesperson stated.
Previously, Mirwaiz had filed a writ petition in the Jammu and Kashmir and Ladakh High Court, which is scheduled for consideration in November 2024. However, the Hurriyat claimed that due to his renewed unauthorized detention, which occurred without formal orders from the administration, he was compelled to file an urgent petition to safeguard his fundamental rights, including his religious freedoms.
The separatist group expressed optimism that the High Court would grant the necessary relief to Mirwaiz, citing the principles of natural justice and human rights enshrined in the Constitution.
In light of the ongoing situation, the Hurriyat appealed to the legal community, political organizations, and human rights advocates to raise awareness about Mirwaiz’s case and advocate for his rights.
