Expelled Congress MLA Rahul Mamkootathil Gets Interim Bail Protection; Next Hearing on December 15

The Kerala High Court on Saturday granted interim protection from arrest to expelled Congress MLA Rahul Mamkootathil, who faces allegations of rape and forced abortion. Justice K. Babu stated that the court would hear his anticipatory bail plea on December 15 and directed that he should not be arrested until then. “Petitioner shall not be arrested during the pendency. Next hearing will be on December 15, 2025. The order said. Advocate S. Rajeev, representing Mamkootathil, confirmed the court’s direction.

Next Hearing Scheduled for Anticipatory Bail of Rahul Mamkootathil 

The relief comes while the MLA remains named in two separate sexual assault cases. The High Court will take up his anticipatory bail plea on December 15, allowing the matter to be reviewed before any custodial action is taken.

Two Separate Sexual Assault Cases Against MLA Rahul Mamkootathil 

A sessions court in Thiruvananthapuram had on Thursday rejected his anticipatory bail plea in the first case, which was registered last week. A second rape case was filed on Wednesday following a complaint by another woman, a resident of Bengaluru.

Sessions Court Earlier Rejected Bail of Rahul Mamkootathil 

Mamkootathil has been absconding since the registration of the first case. In his plea before the High Court, he maintained that he was innocent and claimed custodial interrogation was unnecessary.

Rahul Mamkootathil Claims Consensual Relationship

The MLA argued that the relationship with the first complainant was consensual and that the complaint was filed only after the relationship soured. He stated that the woman was married but separated from her husband and that she disowned their relationship “to save her own skin.” He added that he was ready to explain “each and every circumstance” related to the alleged offences and would cooperate with the investigation if allowed to appear before the authorities without fear of arrest. Mamkootathil also alleged that the probe team was attempting to “mislead the facts” and claimed he had documents to support his assertions.
