The Delhi High Court in the case observed and has directed the city’s civic authorities which includes the Municipal Corporation of Delhi, MCD to submit a time-frame within which the process of removal of concrete around the trees in the national capital will be completed.
The bench headed by Justice Jasmeet Singh in the case observed and has directed the authorities for filing the affidavits which indicates the total number of trees which have been concretized, which have now been de concretized and those which remain to be de concretized.
The court stated that the affidavit shall also indicate as to why the balance number of trees have not been de concretized and the time frame within which the same shall be done. The bench of Justice Singh was hearing the plea moved by Advocate Aditya N Prasad for preservation of trees in the national capital.
The court in the case observed and has asked the authorities for filing an affidavit within the period of two weeks which shall be verified within four weeks.
The plea moved highlighted the inaction of the authorities over concretization of trees in the city’s Vasant Vihar area.
The court also pulled up the South Delhi Municipal Corporation over the issue wherein it has been observed by the court that concretization of trees amounts to worst kind of human rights abuse for the reason that it changes the whole environment of people.
the court while considering the facts and circumstances of the case stated that the constitutional guarantee of citizens’ freedom of movement as enshrined in the Constitution should not be hemmed in by the lack of civic amenities.
Accordingly, the court listed the matter for further consideration on January 29, 2024.
