Gautam Gambhir, BJP MP has been issued summon by a Delhi Court over alleged unauthorised construction of a library by him on MCD land which was meant for a dumping yard. The library is constructed in Priya enclave near Karkardooma court.
Gautam Gambhir was served with a summons on Monday by Additional Senior Civil Judge Himanshu Raman Singh of the Karkardooma Court for the date of December 13, 2022. In a civil lawsuit filed against Gambhir and the MCD, the petitioners’ attorneys, Ravi Bhargava and Rohit Kumar Mahiya, requested a court order prohibiting Gambhir from utilising the allegedly illegal building.
The petitioners argued before the court that Section 91 CPC may apply to the current lawsuit.
After hearing arguments, the court summons the defendant for a settlement conference and issues notice under Order 39 Rule 1 and 2 CPC for 13.12.2022.
According to the lawsuit, Gambhir illegally built a library on MCD land that had previously been used for Dhalao with the help of higher-ups at MCD (dumping yard).
It is said that when MCD authorities removed the dhalao from the 300 square yard plot of land, a BJP MP acquired physical control of the property without first obtaining legal authorization.
The petition mentions a letter or complaint that BJP lawmaker Anil Vajpayee made to the L-G on this.
The petitioners have also cited an article from a national English newspaper from October 7, 2022, in which Gambhir is believed to have stated that he has not obtained approval from any authorities.
The lawsuit has also asked the court to order the MCD to seize the property and tear down the illegal building that was built there.
