Italy’s data protection authority, Garante, has fined OpenAI €15 million ($15.6 million) following an investigation into the popular AI chatbot ChatGPT. The probe revealed multiple privacy violations, including the collection of personal data without a proper legal basis and a lack of transparency in informing users about data usage.

Transparency and Legal Basis Lacking

Garante stated that OpenAI failed to provide sufficient information to users regarding how their personal data was being processed. It further highlighted that OpenAI did not have an “adequate legal basis” for using users’ data to train ChatGPT’s AI models.

Concerns Over Age Verification

Another significant issue raised during the investigation was the absence of an effective age verification system to prevent users under 13 from accessing ChatGPT. The watchdog emphasized that this failure exposed minors to potentially inappropriate AI-generated content.

OpenAI’s Response to the Fine

OpenAI criticized the decision as “disproportionate” and announced plans to appeal.

“This fine is nearly 20 times the revenue we made in Italy during the relevant period,” an OpenAI spokesperson said.
Despite the fine, OpenAI reaffirmed its commitment to collaborating with global privacy authorities and ensuring its AI technologies respect privacy rights.

Public Awareness Campaign Mandated
