Rajasthan HC lifts 11-year ban, electricity connections now available

The residents of Prithviraj Nagar had long been advocating for the lifting of the connection ban. The ban on giving electricity connections on society lease in Prithviraj Nagar of the capital has been lifted. Following the High Court’s ruling, an atmosphere of jubilation swept through the community. Mangalanand Singh from the Maa Karni Indra Nagar Development Committee expressed gratitude towards the High Court for acknowledging public sentiment with its significant decision. He emphasized that this ruling would offer immense relief to the residents who had endured years without electricity, a situation that also impacted children’s education.

The Division Bench of Rajasthan High Court ordered to lift the ban on providing electricity connections about 11 years ago. In such a situation, about 30 thousand families will be able to get electricity connections. Till now these families were living in darkness while some had installed solar systems on their homes. The bench of Justice Pankaj Bhandari and Justice Shubha Mehta passed this order while hearing the appeals of the residents of Prithviraj Nagar and Jaipur Vidyut Vitaran Nigam (JVVNL). On July 5, 2013, the single bench of the High Court had banned giving electricity connections on society leases in Prithviraj Nagar. After the decision, Prithviraj Nagar Jan Vikas Samiti President Anil Mathur said that this day of decision is a big day for us. After a long battle we have got victory today. We are grateful to the High Court’s decision. In this entire matter, the state government had also agreed to provide electricity connections to the society leaseholders and occupants in Prithviraj Nagar. In the meeting held on May 5, 2023 under the chairmanship of the Chief Secretary, not giving electricity connection was not considered legal. At the same time, it was decided that this consent letter should be filed in the court.

Advocate Prahlad Sharma, appearing on behalf of the appellants, said that on November 3, 2023, the single bench of the High Court rejected the petitions saying that the single bench itself had stayed the provision of electricity connections. In such a situation, the second single bench cannot change the order. The court held that under Section 43 of the Electricity Act, no person can be deprived of electricity connection. The residents of Prithviraj Nagar and JVVNL had appealed against this in the division batch of the High Court. Hearing which, the Division Bench of the High Court has lifted the ban on electricity connections.

Actually, the then state government had issued an order for regularization of Prithviraj Nagar on 21 June 2021. Against this, the successful allottees of Prithviraj Nagar Scheme had reached the High Court saying that the government is going to regulate the encroachers in Prithviraj Nagar but is not allotting plots to the successful allottees. At the same time, this regulation order is regarding 11 bighas of land. The Governor’s consent has not even been taken in this. Hearing this, on July 5, 2013, the High Court canceled the regulation order. While ordering to give lease to successful allottees, ban on giving society lease and electricity connections to occupants in Prithviraj Nagar.

The people of Prithviraj Nagar were demanding removal of the ban on connection for a long time. In such a situation, after the order of the High Court, an atmosphere of happiness was seen among the people. Mangalanand Singh of Maa Karni Indra Nagar Development Committee said that the High Court has given a very big decision considering the public sentiments. This will provide great relief to the people. He said that people had been living here without electricity for years. In such a situation, children’s education was also getting affected.
